Unlike other modes of <\/span><a href=\"https:\/\/www.thebalancecareers.com\/types-of-separation-from-employment-2061665\"><span style=\"font-weight: 400;\">employment severance<\/span><\/a><span style=\"font-weight: 400;\">, the employee in this case, terminates their employment due to an unbearable working environment.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Constructive Discharge Examples<\/span><\/i><\/h4>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The employee quits because they are being discriminated against in their workplace.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An employee terminates their employment because they are being harassed at work.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The employee resigns because they are being mistreated, for example, they receive a reduction in pay that is not related to their performance in the workplace.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Instead of firing the employee, the employer creates a hostile environment so that the employee can quit.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Typically, a constructive discharge can result in an employee being able to make a <\/span><a href=\"https:\/\/employment.findlaw.com\/losing-a-job\/wrongful-termination-claims.html\"><span style=\"font-weight: 400;\">wrongful termination<\/span><\/a><span style=\"font-weight: 400;\">, harassment or discharge claim. These are some examples of claims that could lead to an employee obtaining compensation from the employer.<\/span><\/p>\n<h2><b>Why Would an Employee Want to Bring a Claim?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Most employees that resign do not receive <\/span><a href=\"https:\/\/www.investopedia.com\/terms\/u\/unemployment-compensation.asp\"><span style=\"font-weight: 400;\">unemployment benefits<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.thebalancecareers.com\/termination-from-employment-2060505\"><span style=\"font-weight: 400;\">dismissal compensation<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/dictionary.cambridge.org\/dictionary\/english\/severance-package\"><span style=\"font-weight: 400;\">severance packages<\/span><\/a><span style=\"font-weight: 400;\">. This is because technically they will be considered to have voluntarily quit. However, if an employee has been constructively discharged, they will not only be able to claim these benefits, but will <\/span><a href=\"https:\/\/www.thebalancecareers.com\/what-is-constructive-discharge-2061654#citation-10\"><span style=\"font-weight: 400;\">still be able to sue<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>General Elements of a Successful Constructive Discharge Suit<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Legally, an employee who is successful in a constructive termination case, converts the status of the termination of employment from voluntary to involuntary. In essence they are now considered to have been fired and can claim benefits. Due to this, a constructive termination lawsuit cannot be brought in isolation, but must be accompanied by a claim that an underlying wrong was committed, such as discrimination. Consequently, a successful constructive termination lawsuit shows that an employee was forced to quit through wrongful or illegal means.\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Successful Constructive Discharge Example<\/span><\/i><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Status <\/span><span style=\"font-weight: 400;\">prior<\/span><span style=\"font-weight: 400;\"> to claim: Employee quit job<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Status following a <\/span><span style=\"font-weight: 400;\">successful<\/span><span style=\"font-weight: 400;\"> claim: Employee was forced to quit because the employer created a hostile environment by discriminating against them.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Making a successful claim of constructive termination is not easy as there are a series of elements present that can sometimes be difficult to establish. The following is a breakdown of these key components of a successful claim.\u00a0<\/span><\/p>\n<h2><b>The Hostile Environment Breaches the Law<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In a majority of cases, for a workplace to be considered hostile, a law must have been breached. These include laws prohibiting sexual harassment or discrimination based on any <\/span><a href=\"https:\/\/www.equalityhumanrights.com\/en\/equality-act\/protected-characteristics\"><span style=\"font-weight: 400;\">protected characteristic<\/span><\/a><span style=\"font-weight: 400;\">. A hostile environment can also be a result of an employer not taking the necessary steps to accommodate a disabled employee, even if it was an act of <\/span><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/0-107-6876?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\"><span style=\"font-weight: 400;\">negligence<\/span><\/a><span style=\"font-weight: 400;\"> and unintentional.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If an employer retaliates against a whistleblower by creating a hostile environment this can still be the basis for a claim.<\/span><\/p>\n<p><img loading=\"lazy\" class=\"aligncenter wp-image-296 size-medium\" src=\"https:\/\/blog.harmonizehq.com\/wp-content\/themes\/veen\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.01-PM-300x149.png\" alt=\"hostile environment\" width=\"300\" height=\"149\" data-srcset=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.01-PM-300x149.png 300w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.01-PM-1024x510.png 1024w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.01-PM-768x382.png 768w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.01-PM.png 1278w\" data-sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h2><b>The Claim is Brought Soon After the Employee Resigns<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Employees wishing to bring a claim must consider the <\/span><a href=\"https:\/\/dictionary.cambridge.org\/dictionary\/english\/statute-of-limitations\"><span style=\"font-weight: 400;\">statute of limitations<\/span><\/a><span style=\"font-weight: 400;\"> for bringing a claim. This time period varies depending on the jurisdiction and the nature of the employees work, for example, federal employees in the United States have a small window of <\/span><a href=\"https:\/\/www.eeoc.gov\/time-limits-filing-charge\"><span style=\"font-weight: 400;\">45 days<\/span><\/a><span style=\"font-weight: 400;\"> from the relevant date to sue. The time period to bring a claim will be further explained in the jurisdiction section.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It must be noted that often, successful claims result from an employee resigning soon after an instance of mistreatment. However, cases are more likely to be successful where the employee exhausts all internal complaints procedures, such as filing a formal complaint for sexual harassment. This is because an employee has to show that the employer was aware of the hostile environment and failed to make any changes accordingly.\u00a0<\/span><\/p>\n<h2><b>How Do You Prove Constructive Discharge?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/8-502-6326?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\"><span style=\"font-weight: 400;\">burden of proof<\/span><\/a><span style=\"font-weight: 400;\"> is with the employee, this means the employee has to prove a series of facts. The employee will have to show that they were mistreated by the employer; that the employer was aware of this mistreatment; that the employer failed to remedy the hostile nature of the workplace; that they resigned because of this hostile environment; and that the reasonable person in the employees circumstances would also have resigned.\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Mistreatment<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">To prove that there was <\/span><a href=\"https:\/\/www.lexisnexis.com\/legalnewsroom\/labor-employment\/b\/top-blogs\/posts\/do-i-have-a-case-for-constructive-discharge\"><span style=\"font-weight: 400;\">mistreatment<\/span><\/a><span style=\"font-weight: 400;\">, simple evidence that an employer is being cruel is insufficient. As previously mentioned, there needs to be breach of a relevant law, such as anti-discrimination law. This is because the presumption is that employees undertake <\/span><a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/employment-at-will-definition-30022.html\"><span style=\"font-weight: 400;\">at-will<\/span><\/a><span style=\"font-weight: 400;\"> employment. This means that, generally, employers are not under any duty to provide a\u00a0 stress-free environment or treat staff fairly. They are only obliged and duty bound, not to discriminate against their employees or act in any other unlawful manner. Therefore, to prove constructive termination it is key that unlawful conduct can be exhibited.\u00a0\u00a0<\/span><\/p>\n<p><img loading=\"lazy\" class=\"aligncenter wp-image-297 size-medium\" src=\"https:\/\/blog.harmonizehq.com\/wp-content\/themes\/veen\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.51-PM-300x132.png\" alt=\"mistreatment\" width=\"300\" height=\"132\" data-srcset=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.51-PM-300x132.png 300w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.51-PM-1024x449.png 1024w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.51-PM-768x337.png 768w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.31.51-PM.png 1268w\" data-sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">It must also be noted that in most circumstances a series of misconducts or a pattern of egregious behaviour is needed to show that the employee was working in a hostile environment. In some circumstances one severe act can be sufficient, this singular act however, is typically a crime such as sexual assault or another form of violence against an employee by an employer. Isolated instances of negative behaviour or a poor <\/span><a href=\"http:\/\/www.businessdictionary.com\/definition\/performance-appraisal.html\"><span style=\"font-weight: 400;\">performance appraisal<\/span><\/a><span style=\"font-weight: 400;\"> cannot generally establish that the employee was working in intolerable conditions.\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Employer\u2019s Knowledge<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">It is not sufficient to only show that the working environment was hostile, employees have to show that the employer was aware of this environment and did nothing to remedy this. Showing that the employer ought to have known about the conduct is not enough to prove constructive termination. This is the case even if a large group of employees were the cause of the hostile environment, it must be shown that the employer was aware of this hostile work environment and took no action to fix it. Establishing employer knowledge typically requires evidence that the employee filed complaints to the relevant managerial staff, and that no subsequent action was taken to improve conditions. If the employer did not learn about the hostile work environment, the employee will be unsuccessful in a constructive termination lawsuit. It must be noted that even if it seems as though the employer is purposefully ignoring signs of a hostile environment, evidence of filed complaints is still generally required to lead a successful claim. This is because cases like this are hard to prove, and establishing employer knowledge is difficult without substantial evidence.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Reasonable Person<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The employees subjective opinion that their working environment was hostile is insufficient to prove constructive termination. The Court must believe that the <\/span><a href=\"https:\/\/www.merriam-webster.com\/legal\/reasonable%20person\"><span style=\"font-weight: 400;\">reasonable person<\/span><\/a><span style=\"font-weight: 400;\"> in the employees position would have found the working conditions intolerable and would have quit as a result. If it cannot be established that the reasonable person, in the employee&#8217;s circumstances, would have found that the workplace was a hostile environment, they will be deemed to have voluntarily resigned. As such they would have failed to prove constructive termination.\u00a0<\/span><\/p>\n<h2><strong>Law by Jurisdiction<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">The nature of a claim and the requirements for a successful suit, vary depending on an individual\u2019s legal jurisdiction. This section will look at three key jurisdictions, specifically the United States, United Kingdom and Canada and their laws on constructive termination.\u00a0<\/span><\/p>\n<h3><b>United States<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Constructive Discharge was a legal concept that was initially intended to protect Unionised employees, however the courts have since extended it to circumstances concerning non-unionised employees as well. In the United States, <\/span><a href=\"https:\/\/www.natlawreview.com\/article\/what-constructive-discharge-and-how-does-it-relate-to-my-employment-discrimination\"><span style=\"font-weight: 400;\">constructive discharge<\/span><\/a><span style=\"font-weight: 400;\"> is defined as the reasonable decision of an employee to quit due to an unendurable hostile work environment. Their resignation is deemed as involuntary. The hostile work environment typically violates the following legislation:<\/span><\/p>\n<ul>\n<li><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\"><span style=\"font-weight: 400;\">The Fair Labor Standards Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1938<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Act establishing minimum wage, record keeping, overtime pay, and the standards for youth employment<\/span><\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/www.eeoc.gov\/statutes\/equal-pay-act-1963\"><span style=\"font-weight: 400;\">Equal Pay Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1963<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Prohibits wage discrimination based on sex<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">Title VII of the <\/span><a href=\"https:\/\/www.eeoc.gov\/statutes\/title-vii-civil-rights-act-1964\"><span style=\"font-weight: 400;\">Civil Rights Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1964<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Prohibits discrimination based on race, religion, colour, national origin and sex<\/span><\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/www.eeoc.gov\/statutes\/age-discrimination-employment-act-1967\"><span style=\"font-weight: 400;\">Age Discrimination in Employment Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1967<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Prohibits employment discrimination against individuals who are 40 years old or older<\/span><\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/www.dol.gov\/general\/topic\/disability\/ada\"><span style=\"font-weight: 400;\">Americans with Disabilities Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1990<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Prohibits discrimination against individuals with disabilities<\/span><\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fmla\"><span style=\"font-weight: 400;\">Family and Medical Leave Act<\/span><\/a><span style=\"font-weight: 400;\"> of 1993<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">This Act gives certain employees the right to take unpaid leave for specific medical and family reasons, all while their job is protected.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/www.eeoc.gov\/statutes\/genetic-information-nondiscrimination-act-2008\"><span style=\"font-weight: 400;\">Genetic Information Nondiscrimination Act<\/span><\/a><span style=\"font-weight: 400;\"> of 2008<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Prohibits discrimination based on genetic information in relation to employment and health insurance<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">Any other State employment law<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">One of the main bodies that investigates and regulates the enforcements of civil rights and anti-discrimination laws in the workplace is the <\/span><a href=\"https:\/\/www.eeoc.gov\/\"><span style=\"font-weight: 400;\">Equal Employment Opportunity Commission<\/span><\/a><span style=\"font-weight: 400;\"> (hereafter EEOC). Generally employees who want to bring legal action against their employer will have to first <\/span><a href=\"https:\/\/www.eeoc.gov\/filing-lawsuit\"><span style=\"font-weight: 400;\">file a charge with the EEOC<\/span><\/a><span style=\"font-weight: 400;\">. The EEOC will then conduct an investigation, after which they may present the employee with a Notice of a Right to Sue Letter. Employees may also request a Notice of a Right to Sue Letter directly from the EEOC if they do not want to wait for the EEOC investigation to be completed. Once employees obtain this letter, they then have 90 days to file a lawsuit, failure to do so may prevent an employee from bringing legal action.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Statute of Limitations<\/span><\/i><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">The Statute of Limitations is the time period where a lawsuit can be filed. For employees wishing to bring a constructive termination lawsuit the <\/span><a href=\"https:\/\/www.jacksonlewis.com\/publication\/supreme-court-constructive-discharge-limitations-period-begins-notice-resignation\"><span style=\"font-weight: 400;\">time periods<\/span><\/a><span style=\"font-weight: 400;\"> are as follows:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/dictionary.cambridge.org\/dictionary\/english\/private-sector\"><span style=\"font-weight: 400;\">Private Sector<\/span><\/a><span style=\"font-weight: 400;\"> Employees: 180 days (300 days if they are filing in a state that has a <\/span><a href=\"https:\/\/definitions.uslegal.com\/s\/state-agency\/\"><span style=\"font-weight: 400;\">state agency<\/span><\/a><span style=\"font-weight: 400;\">) from the day they give their notice of resignation, to file a charge with the EEOC.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/definitions.uslegal.com\/f\/federal-employee\/\"><span style=\"font-weight: 400;\">Federal Employees<\/span><\/a><span style=\"font-weight: 400;\">: <\/span><a href=\"https:\/\/www.passmanandkaplan.com\/blog\/2016\/05\/news-from-the-supreme-court-constructive-discharge-decision.shtml\"><span style=\"font-weight: 400;\">45 days<\/span><\/a><span style=\"font-weight: 400;\"> from the day they give their notice of resignation, to file a charge with the EEOC.<\/span><\/li>\n<\/ul>\n<h4><i><span style=\"font-weight: 400;\">Burden of Proof<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">The employee has the burden of proof and has to prove that they were constructively discharged. Employees who want to succeed in a claim are also required to demonstrate that the reasonable person in their position would also have resigned.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Remedies<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">If an employee is successful in their suit, they may be entitled to the following remedies which are associated with <\/span><a href=\"https:\/\/www.wrongfulterminationlaws.com\/resources\/wrongful-termination-law\/wrongful-termination-claims\/remedies-for-termination.htm\"><span style=\"font-weight: 400;\">wrongful termination<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.eeoc.gov\/employers\/remedies-employment-discrimination\"><span style=\"font-weight: 400;\">employment discrimination<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Back Pay\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Damages to compensate the employee for their loss of earning from time of termination to the time of trial.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Front Pay\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Damages to compensate the employee for their future loss of earning from the time of trial. This remedy is available where the employee is unable to find employment or their new job pays less than their previous one.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Lost Benefits\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">This is compensation for any benefits the employee lost due to termination.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Out-of-Pocket Losses<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Compensation for other costs as a result of your termination. The purpose of them is to punish the employer for their conduct.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.eeoc.gov\/remedies-employment-discrimination#:~:text=Compensatory%20damages%20pay%20victims%20for,loss%20of%20enjoyment%20of%20life)\"><span style=\"font-weight: 400;\">Compensation is capped<\/span><\/a><span style=\"font-weight: 400;\"> due to Federal Law. This means there is a limit for the award that an employee can receive for compensatory and punitive damages. The limit is based on the employer\u2019s size and are as follows:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employers that have 15 to 100 employees: $50,000<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employers that have 101 to 200 employees: $100,000<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employers that have 201 to 500 employees: $200,000<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employers that have over 500 employees: $300,000.<\/span><\/li>\n<\/ul>\n<h4><i><span style=\"font-weight: 400;\">Chances of a Constructive Discharge Claim Being Successful<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">Only a small percentage of people who have quit employment will meet the requirements to successfully bring a constructive termination lawsuit. Additionally, it is hard to prove a constructive termination case. As such, it is often advised that if possible, employees contact an employment and labour lawyer to discuss their case and gain more insight. Understandably, remaining in a workplace that is hostile can be a difficult choice for an employee, considering that many people working in such environments experience some detriment to their mental and physical wellbeing. However, it is still advised that they contact a lawyer prior to termination of employment to determine their likelihood of making a successful claim and to better understand the consequences of resignation and a failed claim. This definition is essentially the same as previous definitions that have been given for constructive discharge in this article.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The circumstances where the employee is entitled to terminate their employment without notice, are dictated by common law. A constructive dismissal claim is usually brought based on a breach of the <\/span><a href=\"https:\/\/www.lexisnexis.co.uk\/legal\/guidance\/the-term-of-trust-and-confidence\"><span style=\"font-weight: 400;\">implied term of trust and confidence<\/span><\/a><span style=\"font-weight: 400;\"> within all employment contracts. An <\/span><a href=\"https:\/\/publications.parliament.uk\/pa\/ld199798\/ldjudgmt\/jd970612\/malik01.htm\"><span style=\"font-weight: 400;\">employer breaches<\/span><\/a><span style=\"font-weight: 400;\"> this if they \u201cwithout reasonable or proper cause, conduct themselves in a manner calculated or likely to destroy or seriously damage the relationship of trust and confidence between the employer and the employee\u201d. A constructive dismissal breach can also arise out of a fundamental breach of any <\/span><a href=\"https:\/\/hjsolicitors.co.uk\/article\/contracts-express-and-implied-terms\/#:~:text=Implied%20terms%20are%20terms%20implied,day%20one%20of%20the%20contract.\"><span style=\"font-weight: 400;\">implied or express term<\/span><\/a><span style=\"font-weight: 400;\"> of the employment contract.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.gov.uk\/dismissal\/unfair-and-constructive-dismissal\"><span style=\"font-weight: 400;\">UK government<\/span><\/a><span style=\"font-weight: 400;\"> issued some examples of conduct that can be deemed serious enough to constitute a constructive dismissal:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">If your employer suddenly demotes you without cause <\/span><\/li>\n<li>If your employer does not pay you<\/li>\n<li><span style=\"font-weight: 400;\">If your employer forces you to accept unreasonable alterations to the nature of your work<\/span>\n<ul>\n<li><i><span style=\"font-weight: 400;\">Example<\/span><span style=\"font-weight: 400;\">: They tell you to work night shifts when you are only contracted to work day shifts<\/span><\/i><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">If your employer makes you work in unsafe conditions<\/span><\/li>\n<li><span style=\"font-weight: 400;\">They are aware of and allow coworkers to bully and harass you<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The government also highlights that this conduct can be a singular serious incident or a collection of incidents that, together, can be serious. It must be noted that if an employee believes they have a case for constructive termination, they must terminate their employment immediately. If they do not, the employer can argue that they have accepted the treatment that they received, and have therefore accepted any breach their employer has made.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Common Law v Statutory Dismissal<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">There are two types of Constructive Dismissal, common law and statutory constructive dismissal.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.peninsulagrouplimited.com\/corporate-eye\/corporate-eye-issue-4\/prominent-case-principles-western-excavating-ecc-ltd-v-sharp-1978-icr-221-ca\/\"><span style=\"font-weight: 400;\">Common law<\/span><\/a><span style=\"font-weight: 400;\"> constructive dismissal is the case where an employer knowingly or unknowingly terminates an employment contract by committing a repudiatory breach and the employee accepts this breach. However, both of these claims are different from constructive dismissal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unlike a constructive dismissal, an <\/span><a href=\"https:\/\/www.gov.uk\/dismiss-staff\/unfair-dismissals\"><span style=\"font-weight: 400;\">unfair dismissal<\/span><\/a><span style=\"font-weight: 400;\"> is where an employee is fired in an unlawful manner. For example, where an employee is fired because they are pregnant. The reason a claim can be brought for both a constructive dismissal and unfair dismissal is because it is <\/span><a href=\"https:\/\/www.gov.uk\/dismiss-staff\"><span style=\"font-weight: 400;\">hard for employers\u00a0 to establish<\/span><\/a><span style=\"font-weight: 400;\"> that a constructive dismissal was lawful and fair. Employees must take note that they are only eligible to bring an unfair dismissal claim if they have been an <\/span><a href=\"https:\/\/www.gov.uk\/employment-status\/employee\"><span style=\"font-weight: 400;\">employee<\/span><\/a><span style=\"font-weight: 400;\"> for a continuous period of <\/span><a href=\"https:\/\/www.gov.uk\/dismissal\/what-to-do-if-youre-dismissed\"><span style=\"font-weight: 400;\">at least 2 years<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><a href=\"https:\/\/www.gov.uk\/dismiss-staff\"><span style=\"font-weight: 400;\">Wrongful dismissal<\/span><\/a><span style=\"font-weight: 400;\"> occurs where an employer breaches the terms of a contract while terminating employment. For example, if an employer dismisses an employee without the proper notice period.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Grounds<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">The grounds for constructive dismissal are all follows:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">Changes to the contract made solely by the employer,\u00a0<\/span><\/i><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.casemine.com\/judgement\/uk\/5a8ff87560d03e7f57ec0d71\"><span style=\"font-weight: 400;\">complaints<\/span><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/swarb.co.uk\/horkulak-v-cantor-fitzgerald-international-qbd-31-jul-2003\/\"><span style=\"font-weight: 400;\">swearing<\/span><\/a><span style=\"font-weight: 400;\"> and or bullying\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employer singles out employee by not giving them a <\/span><a href=\"https:\/\/library.croneri.co.uk\/cch_uk\/p11d\/161-220\"><span style=\"font-weight: 400;\">pay rise<\/span><\/a><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">any verbal abuse that for example, refers to <\/span><a href=\"https:\/\/www.lawteacher.net\/free-law-essays\/employment-law\/uum-opac-uum-colgis-legal-law-essays.php\"><span style=\"font-weight: 400;\">gender<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/swarb.co.uk\/courtaulds-northern-textiles-ltd-v-andrew-eat-1979\/\"><span style=\"font-weight: 400;\">incompetence<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/www.personneltoday.com\/hr\/bitter-resignation\/\"><span style=\"font-weight: 400;\">size<\/span><\/a><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employer criticises employee in from of their <\/span><a href=\"https:\/\/swarb.co.uk\/hilton-international-hotels-v-protopapa-eat-1990\/\"><span style=\"font-weight: 400;\">subordinates<\/span><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employer does not notify a woman on <\/span><a href=\"https:\/\/www.casemine.com\/judgement\/uk\/5a8ff7e760d03e7f57eb2be6\"><span style=\"font-weight: 400;\">maternity<\/span><\/a><span style=\"font-weight: 400;\"> leave of a vacancy that she would have applied for had she been present or notified of the position<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employee experiences a lack of <\/span><a href=\"https:\/\/www.lawblacks.com\/2013\/03\/11\/lord-sugar-not-sweet-enough-apprentice-winner-claims-constructive-dismissal\/\"><span style=\"font-weight: 400;\">support<\/span><\/a><span style=\"font-weight: 400;\">, for example, they are forced to do the work of two people<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employer reveals concealed complaints in a <\/span><a href=\"https:\/\/www.thompsonstradeunion.law\/news\/lelr\/weekly-issue-46-may-2000\/watch-your-mouth\"><span style=\"font-weight: 400;\">reference<\/span><\/a><span style=\"font-weight: 400;\">, this is the case even is a reference is required by a regulator<\/span><\/li>\n<\/ul>\n<ul>\n<li 400;\">outside the boundaries<\/span><\/a><span style=\"font-weight: 400;\"> of good industrial practice, or behaviour that in unjust, unbearable, erratic or random<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">exhibiting any form of behaviour that <\/span><a href=\"https:\/\/www.casemine.com\/judgement\/uk\/5a8ff75560d03e7f57eab689\"><span style=\"font-weight: 400;\">undermines trust <\/span><\/a><span style=\"font-weight: 400;\">and confidence\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employee is tricked into resigning by employer (<\/span><span style=\"font-weight: 400;\">Caledonian Mining Co Ltd v Bassett<\/span><span style=\"font-weight: 400;\">\u00a0[1990] ICR 425)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">employer refuses the transfer of an employee to an alternative post on the basis of workplace <\/span><a href=\"https:\/\/www.casemine.com\/judgement\/uk\/5a8ff78d60d03e7f57eaf011\"><span style=\"font-weight: 400;\">stress<\/span><\/a><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It must be noted that employees do not have an automatic right to <\/span><a href=\"https:\/\/swarb.co.uk\/murco-petroleum-ltd-v-forge-eat-1987\/\"><span style=\"font-weight: 400;\">pay rise<\/span><\/a><span style=\"font-weight: 400;\">, further a <\/span><a href=\"https:\/\/www.xperthr.co.uk\/law-reports\/contracts-of-employment-smoking-ban-upheld\/34405\/\"><span style=\"font-weight: 400;\">smoking ban<\/span><\/a><span style=\"font-weight: 400;\"> does not constitute a reasonable ground for constructive dismissal. Additionally, the person that causes the dismissal is not required to have authority to dismiss an employee, the only requirement is that they must be acting in the <\/span><a href=\"https:\/\/www.personneltoday.com\/hr\/dangerous-talk\/\"><span style=\"font-weight: 400;\">course of their employment<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Statute of Limitations<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">An employee has <\/span><a href=\"https:\/\/www.dfalaw.co.uk\/faq_type\/when-can-an-employee-make-a-claim-for-constructive-dismissal\/#:~:text=Time%20limit%20for%20constructive%20dismissal,lodged%20as%20soon%20as%20possible.\"><span style=\"font-weight: 400;\">3 months<\/span><\/a><span style=\"font-weight: 400;\"> from the date of termination of employment to lodge a claim with the Employment Tribunal.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">The Importance of Timing<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">As has been previously mentioned the employee must resign soon after the employer\u2019s misconduct. If they do not resign immediately after a singular act, they will be deemed to have accepted the employer\u2019s conduct and waived their right to bring a claim. This is the case unless the employee resigns after the last straw.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The last straw is seen as an act that can revive all the employer\u2019s previous misdeeds for the purpose of the law. The purpose of this is that all of the employer\u2019s misconducts will be seen as a <\/span><a href=\"https:\/\/swarb.co.uk\/lewis-v-motorworld-garages-ltd-ca-1985\/\"><span style=\"font-weight: 400;\">string of events<\/span><\/a><span style=\"font-weight: 400;\"> that, together, can be deemed as a fundamental breach and therefore the cause of the employee\u2019s constructive dismissal. The last straw does <\/span><a href=\"https:\/\/swarb.co.uk\/london-borough-of-waltham-forest-v-omilaju-ca-11-nov-2004\/\"><span style=\"font-weight: 400;\">not have to be similar<\/span><\/a><span style=\"font-weight: 400;\"> to past misconducts, it must however, be connected to the obligation of trust and confidence.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An employer may state that the employee accepted a breach because they did not resign, however, if an employee can show that no <\/span><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/3-107-5984?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\"><span style=\"font-weight: 400;\">consideration<\/span><\/a><span style=\"font-weight: 400;\"> was paid, they can state that they did not accept the breach. This is the case even if the employee continued working for the employer for a <\/span><a href=\"https:\/\/swarb.co.uk\/aparau-v-iceland-frozen-foods-plc-ca-12-nov-1999\/\"><span style=\"font-weight: 400;\">year<\/span><\/a><span style=\"font-weight: 400;\">. However, if the employee accepts a new job within this time, they will be taken to have accepted the employer\u2019s breach. As such, it is advised that if the employee wishes to look for new work, they should either <\/span><a href=\"https:\/\/swarb.co.uk\/jones-v-sirl-and-son-furnishers-limited-eat-1997\/\"><span style=\"font-weight: 400;\">work under protest<\/span><\/a><span style=\"font-weight: 400;\">, or better yet, serve their notice of resignation prior to conducting a job search. It must also be noted that if an employee accepts new work prior to giving notice, an employer can argue that termination of employment was because the employee found a new job.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Burden of Proof<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/8-502-6326?__lrTS=20200613093613478&amp;transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\"><span style=\"font-weight: 400;\">burden of proof<\/span><\/a><span style=\"font-weight: 400;\"> lies with the employee, so they must prove that they were constructively dismissed. To be successful in a claim the employee must also demonstrate that the reasonable person in the employees position would also have resigned.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Remedies<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">A constructive dismissal claim is a contractual claim, and can be brought to the <\/span><a href=\"https:\/\/www.gov.uk\/courts-tribunals\/employment-tribunal\"><span style=\"font-weight: 400;\">Employment Tribunal<\/span><\/a><span style=\"font-weight: 400;\"> or a Court. As a contractual claim, there is no cap on compensation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If an employee\u2019s claim is successful in the Employment Tribunal they are awarded a combination of a <\/span><a href=\"https:\/\/www.landaulaw.co.uk\/faqs\/what-compensation-would-you-receive-in-a-constructive-dismissal-claim\/\"><span style=\"font-weight: 400;\">basic and compensatory award<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The basic award is a statutory award that is calculated by considering an employee\u2019s length of continuous service, their weekly pay at the time of contract termination, and their age. A tribunal holds the right to reduce the basic award on the basis of an employees conduct prior to termination.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The compensatory award is often a much larger sum than the basic award. <\/span><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1996\/18\/section\/123?view=plain\"><span style=\"font-weight: 400;\">Section 123(1)<\/span><\/a><span style=\"font-weight: 400;\"> of the Employment Rights Act 1996 states that this award shall be a sum that the Tribunal believes to be just and fair taking into account the loss suffered by the employee. Further, the loss needs to be a result of the employees resignation and the employer\u2019s actions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are four main losses that can be claimed under the compensatory award:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">Loss of wages<\/span><\/i>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This includes contractual benefits such as health insurance or a company car<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Loss of pension<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Loss of future wages<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Loss of statutory rights\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">For example being forced to quit prior to 2 years which would result in an employee being unable to bring an unfair dismissal claim<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>Canada<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In Canada, constructive discharge is more commonly known and constructive dismissal, disguised dismissal or quitting in cause. <\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/programs\/laws-regulations\/labour\/interpretations-policies\/constructive-dismissal.html\"><span style=\"font-weight: 400;\">Constructive dismissal<\/span><\/a><span style=\"font-weight: 400;\"> in Canada is covered by Part III of the <\/span><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/L-2\/index.html\"><span style=\"font-weight: 400;\">Canada Labour Code<\/span><\/a><span style=\"font-weight: 400;\"> and is defined as where an employee is forced to quit because an employer substantially fails to abide by the contract of employment; changes the terms of the employment contract on their own; or shows conviction to carry out these two aforementioned acts. It is essentially an employer\u2019s failure to meet their contractual obligations. It was also determined in the case of Srougi\u00a0v. Lufthansa German Airlines, [1988]\u00a0F.C.J.\u00a0N\u00ba\u00a0539 that where an employee is determined to be constructively discharged, they have certainly been unjustly dismissed. This means that the remedies for unjust dismissal also apply to cases of constructive dismissal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The employer\u2019s actions must be without the employee\u2019s consent. Like in the UK, if the conduct of the employer is deemed to be accepted or with the consent of the employee, it will not be a case of constructive dismissal, but simply a change in the contract terms. The employee must show non-acceptance, as such, they must resign after a reasonable and short period after the employer\u2019s deviation from the agreed contract. In some cases, if the employee continues to work for the employer, the court will still decide that the employee did not accept the employer\u2019s conduct. Such circumstances include:\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Where the employee continues to work but under protest<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Where the employee continues to work for the employer while filing a lawsuit\u00a0<\/span><\/li>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If the employee attempts to negotiate with the employer while remaining under their employ, the court will determine that they have accepted the employer\u2019s changes to the employment contract.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Situations that can Result in Constructive Dismissal<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">The following is a list of circumstances that can result in a constructive dismissal:<\/span><\/p>\n<ul>\n<li><i><span style=\"font-weight: 400;\">Changes in Duties and Powers<\/span><\/i>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This is the most common ground for a constructive dismissal claim. This is where the employee quits because of a substantial change to the nature of the duties.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This usually involves a significant decrease in status.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">For example, a supply chain director whose duties are now confined to those of a singular factory manager.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This is the case even if the job title and salary of the employee remains unchanged.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><img loading=\"lazy\" class=\"size-medium wp-image-299 aligncenter\" src=\"https:\/\/blog.harmonizehq.com\/wp-content\/themes\/veen\/assets\/images\/transparent.gif\" data-lazy=\"true\" data-src=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.33.32-PM-300x131.png\" alt=\"\" width=\"300\" height=\"131\" data-srcset=\"https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.33.32-PM-300x131.png 300w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.33.32-PM-1024x446.png 1024w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.33.32-PM-768x335.png 768w, https:\/\/blog.harmonizehq.com\/wp-content\/uploads\/Screen-Shot-2020-09-25-at-1.33.32-PM.png 1280w\" data-sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Suspensions and Threats<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In some cases the courts have decided that there has been constructive dismissal where an employee resigns due to threats of demotion or dismissal.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A constructive dismissal can also be based on an unfair suspension or salary reduction.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It must be noted that encouragement from an employer to resign will not constitute as sufficient grounds for a constructive dismissal claim.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Reduction in Salary, Hours, Benefits or Status<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This case involves the employee quitting due to significant changes to the nature of their work, such as working hours or location.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An employee would not be deemed to have been constructively dismissed if they were relocated for work, and they were aware of the potential relocation as a part of their employment.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If an employer changes an employee&#8217;s status, in some cases that can constitute a constructive discharge.<\/span>\n<ul>\n<li style=\"font-weight: 400;\">For example, where changing the status of a salesperson to an independent contractor and therefore, from an employee to an independent contractor.<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">If a company car that is a necessary working tool for an employee and an employer withdraws that vehicle, this may also be deemed as constructive dismissal if the employer does not have a good reason for doing so.<\/span>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Constructive dismissal also applies where an employee quits employment because the workplace is deemed to be so toxic that a reasonable person would not be expected to return to work. A toxic environment is often described as one where criticism is unjustified; accusations of poor performance are unfounded; or where the employee experiences harassment that the employer fails to prevent.<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Statute of Limitations<\/span><\/i><\/h4>\n<p><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/L-2\/page-51.html#h-343168\"><span style=\"font-weight: 400;\">Section 240(2)<\/span><\/a><span style=\"font-weight: 400;\"> of the Canada Labour Code, states that a complaint must be filed 90 days following the employer\u2019s misconduct. This is unless the requirement for an extension under section <\/span><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/L-2\/page-51.html#h-343168\"><span style=\"font-weight: 400;\">240(3)<\/span><\/a><span style=\"font-weight: 400;\"> apply.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Burden of Proof<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">Like in the US and the UK, the <\/span><a href=\"https:\/\/uk.practicallaw.thomsonreuters.com\/8-502-6326?__lrTS=20200613093613478&amp;transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\"><span style=\"font-weight: 400;\">burden of proof<\/span><\/a><span style=\"font-weight: 400;\"> lies with the employee and the employee must demonstrate that the reasonable person in the employees position would also have resigned.\u00a0<\/span><\/p>\n<h4><i><span style=\"font-weight: 400;\">Remedies<\/span><\/i><\/h4>\n<p><span style=\"font-weight: 400;\">A constructive dismissal claim that is successful can possibly afford an employee the following <\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/labour-standards\/reports\/unjust-dismissal.html\"><span style=\"font-weight: 400;\">remedies<\/span><\/a><span style=\"font-weight: 400;\"> from the employer:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">the employee can be reinstated with or without compensation for wages lost<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">this means the employee can get their job back with or without compensation for lost salary<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">compensation for wages lost without the employee being reinstated\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">this means the employee only gets compensation for lost salary<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">anything that is deemed fair to remedy the effects of the dismissal; such as legal costs or the dismissal being cleared from the employees employment record.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; What is Constructive Discharge?
